We are in the middle of a chapter 7 bankruptcy n are 5 months behind on the house payments. The house place wants a relief from the stay or all of the money from where we are behind in. Can we go to a chapter 13 bankruptcy now in order to save the house n can we do it on only the mortgage company?

Why don’t you ask your attorney what you need to do…if you wanted to keep the house, you should have reaffirmed the debt and kept paying the mortgage.
Either just make the payments and stay in a 7. Basically this reafirms your debt with them. Would be worth it to keep the house and let everything else go. If you cant pay then get ready to loose the house because they seldom include a mortgage in a chap 13. Bank will file for relief and forclose on the house.
If you switch your filing it goes for all creditors in the proceeding not just one in particular. The other answer is incorrect, a chapter 13 saves the house, the chapter7 is the one that a house will become disposable property if the mtg is behind and the creditor files for relief.

I used “Credit Solution” to settle my debt and avoid bankruptcy. They managed to reduce my debt up to 58% .It’s legitimate.I came across this company on NBC News Special Edition.Check it out here:
